"La présidence du Conseil est morte, vive la présidence ! Après l'entrée en vigueur du traité de Lisbonne, que reste-t-il de l'ancien modèle de la présidence du Conseil inventé il y a soixante ans par le traité de Paris en 1951? Les interprétations varient. Pour les uns, la présidence semestrielle ne joue presque plus aucun rôle au profit de la nouvelle présidence stable du Conseil européen; pour les autres, elle conserve un poids important et trouve une nouvelle place de nature plus supranationale. La situation s'avère néanmoins plus complexe. Le traité de Lisbonne formalise un "système présidentiel" assez sophistiqué auquel est consacré cet ouvrage. Fruit des transformations de la présidence depuis les années 1980, ce système présidentiel se décompose en cinq modes: la présidence du Conseil européen, le groupe des présidences (trio), la présidence semestrielle, la présidence du Conseil des Affaires générales, la présidence de l'Eurogroupe ou d'autres comités ad hoc. L'originalité de cet ouvrage réside dans le fait que ce système présidentiel sous ses cinq déclinaisons se trouve ici présenté. C'est ainsi que l'on prend la mesure des défis auxquels ce nouveau système se trouve confronté en termes d'organisation et de coordination. Au travers de cet ouvrage, le lecteur est conduit à mesurer le chemin parcouru après une décennie de négociations institutionnelles depuis 2001 et le sommet de Laeken. The book contains a collection of high-quality academic and expert contributions dealing with the central question of whether the Lisbon Treaty needs further revision. Due to the difficulties European Union actors have encountered in implementing the Lisbon Treaty's reform and the inadequacies of the current legal framework brought to light by post-Lisbon practice, the volume focuses on possible innovations and functional approaches to improve the Union's response to the challenges confronting it. In doing so, the volume first takes a horizontal approach to the Treaty' revision and considers some constitutional features showing the interaction between the EU and its Member States (namely, the parameters of constitutional developments, the allocation of competences, the principles of solidarity and loyal cooperation). Then, the focus shifts to the question of fundamental rights within the EU's constitutional framework, one of the most relevant innovations of the Lisbon Treaty being the incorporation of the Charter of Fundamental Rights into the Union's primary law. The last part of the volume is devoted to another domain significantly reshaped by the Lisbon reform, namely, the Union's external dimension. ECJ Advocate General Paolo Mengozzi's conclusions highlight the common themes emerging from the various contributions, stressing the need for a more general supranational approach to the political crisis the Union is going through.
