"Leasehold enfranchisement is the process for people who own property on a long lease ('leaseholders') to extend the lease, or buy the freehold. In order to exercise enfranchisement rights, leaseholders must pay a sum of money ('a premium') to their landlord. This paper summarises our 'Report on options to reduce the price payable', published on 9 January 2020 ('the Report'), and available at www.lawcom. gov.uk/project/leasehold-enfranchisement/. The Report concerns how premiums are calculated. The Report follows our consultation on wide-ranging reforms to the enfranchisement regime. Our Consultation Paper is available at the same address. Our Terms of Reference, agreed with Government, asked us: 'to examine the options to reduce the premium (price) payable by existing and future leaseholders to enfranchise whilst ensuring sufficient compensation is paid to landlords to reflect their legitimate property interests' (emphasis added). LEASE Leaseholders Landlords In accordance with our Terms of Reference, therefore, in the Report: 1. we set out options for reducing premiums and for simplifying the way in which premiums are calculated; but 2. we do not make a recommendation as to how premiums should be calculated. That is a not just a legal question: it involves considerations of law, valuation, social policy, and political judgement, and is therefore for Government and ultimately Parliament to decide. The Report enables Government and Parliament to decide how premiums should be calculated, informed by the consultation responses that we received and by our own expertise and analysis."

The Santa Clara County Planning Office is part of the Department of Planning and Development. Their primary function is to plan and regulate land use and development within the unincorporated portions of Santa Clara County. The Geographic Information Services Department has taken on all those activities related to GIS data and GIS process and procedures that cross organizational boundaries. Santa Clara County encompasses 15 cities and approximately 1.7 million people. The complete and contiguous parcel fabric was then registered and rectified to the best available Public Land Survey (PLS) available. This PLS layer has many inherent inaccuracies related to the original surveys completed in the late 19th and early 20th centuries. As more accurate ground controls become available, the parcel layer will be adjusted. The parcel layer is currently updated roughly twice per year, based on changes to the cadastral maps by the assessor’s drafting function. This can result in delays of several months before updates due to land divisions, mergers, and boundary line adjustment are reflected in the parcel data sets used by these map pages. June 2020.

This book extensively analyses obligations connected to property rights, or?real obligations?, in a comparative perspective through a study of Belgian, French, Dutch and Scots law. Examples of real obligations are the periodical payment obligation of a long lease holder, the maintenance of the property subject to a servitude and the financial contributions by apartment owners.00A real obligation differs in several aspects from a personal obligation. A real obligation is for instance so closely connected to a property right that the obligation transfers automatically to the transferee of the property right. After defining real obligations and the exclusion of several related legal mechanisms in Part I, the regime of real obligations is analysed in Part II. The liability of both the transferor and transferee for real obligations, which are for many property rights underregulated, for instance, are analysed in detail.0Those findings are applied to the specific property rights in Part III, so that particular problems for a specific property right are also analysed and, where possible, solved. For instance the role of party autonomy in the creation of a long lease right is studied. Also the different obligations which can be connected to a servitude are delineated.00Part IV deals with legal mechanisms most of which have recently been introduced, allowing to connect obligations to a piece of property, outside the traditional framework of property rights, such as the Dutch?qualitative obligation? and the French obligation réelle environnementale. The book ends with a discussion of the possibility and desirability of the (broader) introduction of such real obligations, which could entail the introduction of new property rights sui generis.
