The laws of Aethelbert of Kent (ca. 600), Hlohere and Eadric (685x686), and Wihtred (695), are the earliest laws from Anglo-Saxon England, and the first Germanic laws written in the vernacular. They are of unique importance as the only extant early medieval English laws that delineate the progress of law and legal language in the early days of the conversion to Christianity. Aethelbert's laws, the closest existing equivalent to Germanic law as it was transmitted in a pre-literate period, contrast with Hlohere and Eadric's expanded laws, which concentrate on legal procedure and process, and again contrast with the further changed laws of Wihtred which demonstrate how the new religion of Christianity adapted and changed the law to conform to changing social mores. This volume updates previous works with current scholarship in the fields of linguistics and social and legal history to present new editions and translations of these three Kentish pre-Alfredian laws. Each body of law is situated within its historical, literary, and legal context, annotated, and provided with facing-page translation.

For the last 800 years coroners have been important in England's legal and political landscape, best known as investigators of sudden, suspicious, or unexplained death. In contrast, historians have largely ignored, misunderstood, or dismissed the office of coroner in Scotland. Contrary to popular belief, Scotland had coroners, but their functions were quite different from their English namesakes. Against the background of the coroner's role in historic England, this book explains how sudden death was investigated by magistrates in Scotland. It explores how Scottish coroners functioned as executive judicial officers, who serviced criminal circuit courts. They were men of action who dealt primarily with living miscreants and their assets, while also having other tasks, including quasi-military roles. The book explains their place in late medieval and early modern Scottish justice and how, over time, they were side-lined by changes in the constitution of courts and in legal procedures, becoming obsolete in the eighteenth century. Finally, it draws intriguing parallels between the distinctive role of coroners in the north of England and Wales, prior to the seventeenth century, and their counterparts in Scotland. It is a study in legal history, which also sheds valuable light on social, administrative, and political formations in the component parts of historic Britain. It provides essential historical background for understanding the work of coroners in the modern world.

Enforcement has been called the weakest link in the planning control system. This review looks at the scope and effectiveness of the provisions for enforcement of planning control as set out in Parts V and XII of the Town and Country Planning Act 1971 and offers recommendations for improvement. It gives a brief summary of the evolution of the current system and its main features. The author also comments on some of the ideas that have been put forward for improving enforcement, such as introducing a 'Planning Enforcement Tribunal'. Among the main recommendations are that powers to obtain information and secure co-operation before enforcement action should be strengthened. The author also concludes that many of the perceived weaknesses of the system arise from lack of appropriate experience or knowledge on the part of those who have to use it.

Habeas Corpus in Wartime unearths and presents a comprehensive account of the legal and political history of habeas corpus in wartime in the Anglo-American legal tradition. The book begins by tracing the origins of the habeas privilege in English law, giving special attention to the English Habeas Corpus Act of 1679, which limited the scope of executive detention and used the machinery of the English courts to enforce its terms. It also explores the circumstances that led Parliament to invent the concept of suspension as a tool for setting aside the protections of the Habeas Corpus Act in wartime. Turning to the United States, the book highlights how the English suspension framework greatly influenced the development of early American habeas law before and after the American Revolution and during the Founding period, when the United States Constitution enshrined a habeas privilege in its Suspension Clause. The book then chronicles the story of the habeas privilege and suspension over the course of American history, giving special attention to the Civil War period. The final chapters explore how the challenges posed by modern warfare during the twentieth and twenty-first centuries have placed great strain on the previously well-settled understanding of the role of the habeas privilege and suspension in American constitutional law, particularly during World War II when the United States government detained tens of thousands of Japanese American citizens and later during the War on Terror. Throughout, the book draws upon a wealth of original and heretofore untapped historical resources to shed light on the purpose and role of the Suspension Clause in the United States Constitution, revealing all along that many of the questions that arise today regarding the scope of executive power to arrest and detain in wartime are not new ones.
