- Description
- Book — lxxiv, 544 p. ; 26 cm.
- Summary
-
Although Part One of the Civil Code celebrates a decade and a half since its enactment, the final Part Four has been in force for about eighteen months. The "economic constitution" of the Russian Federation required not only some twelve years to be drafted and enacted, but as the keystone legal document in the transition from a socialist Planned Economy to a market-based economic system. The present text contains Parts One, Two, Three, and Four of the Civil Code, as amended. It constitutes the complete Civil Code as contemplated by Russian civil law doctrine. The translation of the Civil Code is based on the official text published in the official gazette and as integrated on the legal data base provided by Consultant Plus.

-
The Third Part of the Civil Code of the Russian Federation was adopted by the Russian Parliament on November 26, 2001, to take effect on March 1, 2002. It has two divisions: Inheritance Law and Private International Law. This translation of the Third Part of the Code by Peter B. Maggs includes an introduction by Professor Maggs as well as all amendments to the first two parts of the Code. Some of these amendments are of a purely technical nature, but some include substantive changes. This volume thus complements the first and second parts of the Civil Code of the Russian Federation, published in 1997 by M.E. Sharpe.

- Summary
-
It is hardly a revelation to say that in the Soviet Union, law served not as the foundation of government but as an instrument of rule, or that the judiciary in that country was highly dependent upon political authority. Yet, experience shows that effective democracies and market economies alike require courts that are independent and trusted. In Courts and Transition in Russia, Solomon and Foglesong analyze the state and operation of the courts in Russia and the in some ways remarkable progress of their reform since the end of Soviet power. Particular attention is paid to the struggles of reformers to develop judicial independence and to extend the jurisdiction of the courts to include constitutional and administrative disputes as well as supervision of pretrial investigations. The authors then outline what can and should be done to make courts in Russia autonomous, powerful, reliable, efficient, accessible and fair. The book draws upon extensive field research in Russia, including the results of a lengthy questionnaire distributed to district court judges throughout Russian Federation. Written in a clear and direct manner, Courts and Transition in Russia should appeal to anyone interested in law, politics, or business in Russia scholars and practitioners alike as well as to students of comparative law, legal transition, and courts in new democracies.

- Summary
-
The 1996 Criminal Code of the Russian Federation replaces the 1960 RSFSR Criminal Code and was adopted by the State Duma on 24 May 1996. It officially entered into force on 1 January 1997. This updated translation contains all amendments up to 1 September 1999. Appended is an index which serves simultaneously as a glossary of the principal terms of Russian criminal law, drawing in part on Butler's earlier translations of the 1958 Fundamental Principles of Criminal Legislation of the USSR and the 1960 RSFSR Criminal Code. The introduction examines criminal law reforms in the Russian Federation, including Russian legal policy toward criminal law. The editor also includes an explanation of how to use the criminal code.
