"Au temps de la première modernité, la "révolution judiciaire" provoque la multiplication des tribunaux, la création de nouvelles juridictions, l'augmentation du nombre des officiers de justice et l'inflation des procédures. Elle touche l'Espagne et ses possessions américaines aussi bien que les autres royaumes d'Europe occidentale. Mais si l'exercice concret de la justice se professionnalise, pour tous ses sujets le roi n'en reste pas moins la source de la justice et c'est de là qu'il tire une part de sa légitimité, de son autorité et de son prestige. Or, la distance qui sépare de l'Europe les juges des Indes, leur donne, presque toujours, une autonomie qu'ils n'ont pas dans l'Ancien Monde, une liberté dont ils profitent et souvent abusent. Peuvent-ils adapter procédures et droit aux réalités nouvelles ? Comment l'image du roi de justice cohabite-t-elle avec les écarts des dépositaires de la justice déléguée ? The North-South global divide is as much about perception and prejudice as it is about economic disparities. Latin America is no less ruled by hegemonic misrepresentations of its national legal systems. The European image of its laws mostly upholds legal legitimacy and international comity. By contrast, diagnoses of excessive legal formalism, an extraordinary gap between law and action, inappropriate European transplants, elite control, pervasive inefficiencies, and massive corruption call for wholesale law reform. Misrepresented to the level of becoming fictions, these ideas nevertheless have profound influence on US foreign policy, international agency programs, private disputes, and academic research. Jorge L. Esquirol identifies their materialization in global governance - mostly undermining Latin American states in legal geopolitics - and their deployment by private parties in transnational litigation and international arbitration. Bringing unrelenting legal realism to comparative law, this study explores new questions in international relations, focusing on the power dynamics among national legal systems.

Beyond High Courts: The Justice Complex in Latin America is a much-needed volume that will make a significant contribution to the growing fields of comparative law and politics and Latin American legal institutions. The book moves these research agendas beyond the study of high courts by offering theoretically and conceptually rich empirical analyses of a set of critical supranational, national, and subnational justice sector institutions that are generally neglected in the literature. The chapters examine the region's large federal systems (Argentina, Brazil, and Mexico), courts in Chile and Venezuela, and the main supranational tribunal in the region, the Inter-American Court of Human Rights. Aimed at students of comparative legal institutions while simultaneously offering lessons for practitioners charged with designing such institutions, the volume advances our understanding of the design of justice institutions, how their form and function change over time, what causes those changes, and what consequences they have. The volume also pays close attention to how justice institutions function as a system, exploring institutional interactions across branches and among levels of government (subnational, national, supranational) and analyzing how they help to shape, and are shaped by, politics and law.
