Although modern international law is now recognized as universally applicable to all the states as soon as they emerge as independent entities (whether members of the United Nations or not, they are accepted as members of the ever-expanding international society, and are bound by its rules and seek its protection), this is only a recent phenomenon not older than the United Nations itself. Before the Second World War, modern international law was supposed to be merely a law of and for the civilized Western European Christian states, or states of European origin, and applicable only between them. Not only Asian and African states, which had come to be colonized, but also the position of independent states, such as Persia, Siam, China, Abyssinia, and the like, was said to be anomalous. Since they belonged to different civilizations, questions were raised as to how far relations with their governments could be based on the rules of international law. If that is the case, when did European international law become universally binding? Can states, which did not, and could not, participate in its origin and development question some of its rules, which are inimical to their interests? How can and does this law change, or be modified, in the absence of any supra-national legislature or other authority? What has been the attitude and practice of these newly independent Asian and African states towards international law, which was largely developed by and for the benefit of the rich and industrialized states of Western Europe and the United States, and even more importantly, their role in its development? The author, an Asian scholar and well-known Professor of International Law, trained and educated in the West, has sought to deal with these and other questions in the nine papers contained in this book.

Despite the disappointing results of fifty years of judicial reform, evidence from Asia suggests that a shift in justice reform efforts could result in important progress being made. Livingston Armytage argues that reform should focus on promoting fairness and equity, as opposed to economic growth and good governance. Less noticed in the West than wars, terrorism and economic trends has been the historic development since World War II of constitutional government and law in Asia. Lawrence W. The Belt and Road Initiative (BRI) put forward by China in 2013 includes the land-based 'Silk Road Economic Belt' and the ocean-based '21st-Century Maritime Silk Road' (MSR) which focuses on the promotion of cooperation between States along the Belt and the Road. As the UN Convention on the Law of the Sea (LOSC) has established the global maritime order, all ocean-related activities generating from the BRI projects along the MSR are in principle subject to the LOSC governance. The Belt and Road Initiative and the Law of the Sea discusses the use of oceans in the context of BRI covering navigational safety, marine energy and sea ports, maritime law enforcement and access of landlocked states to the sea. The absence of a regional system of human rights protection for Asia, and the ambivalence of some Asian states towards existing human rights regimes often results in a lack of awareness of the plight of minorities in these states. The existing human rights literature on Asia tends to focus on the debate of cultural relativism. On the other hand, minority rights literature largely ignores Asia. This book tackles this lacuna by undertaking an analysis of the minority rights legal regimes in India, China, Malaysia and Singapore, while also locating this discussion in the context of a wider debate on human rights in Asia. India and China, the world's most populous states, face similar problems vis-a-vis minorities, yet tackle these using starkly different techniques. Malaysia and Singapore, vocal in their articulation of 'Asian Values', have taken opposing stances over minority rights. Malaysia has sought to establish Malay hegemony using minority rights tools in favour of the majority, while Singapore deliberately adopted a doctrine of meritocracy, nonetheless emphasising ethnic fault-lines within its population. Together the four states reflect not only the complex layers of culture and identity within Asian states, but also the vastly different political systems and contrasting conceptions of the role of law in the continent. Through its examination of minority rights theory and its application in specific cases, this book provides a useful comparative model for the assessment of other states within Asia, thereby taking an important first step towards understanding the situation of minorities within the entire continent.

Many jurisdictions in Asia have vested their courts with the power of constitutional review. Traditionally, these courts would invalidate an impugned law to the extent of its inconsistency with the constitution. In common law systems, such an invalidation operates immediately and retrospectively; and courts in both common law and civil law systems would leave it to the legislature to introduce corrective legislation. In practice, however, both common law and civil law courts in Asia have devised novel constitutional remedies, often in the absence of explicit constitutional or statutory authorisation. This work presents a detailed analysis of the application of the WTO rule on regional arrangements to the current attempts at co-operation in the Asia Pacific region and makes recommendations for an institutional framework for economic integration in the region. The author argues that a framework for regional co-operation must be flexible in allowing for differential sub-regional arrangements and for a development-oriented trade policy, which has been common in some countries in the region. This book systematically studies the structural characteristics of IP laws and regimes of major Asian economies, including (but not always) China, Hong Kong, India, Indonesia, Japan, Korea, Malaysia, Singapore, Taiwan, and Thailand. It explores and crystallizes some worthy Asian models which could further help the development of international IP laws. This book begins with an overview of Asian modern history and IP laws. It discusses the three basic IP laws in Asia which are patent law, trademark law and copyright law. It looks at the pre-established damages for copyright infringement and trademark counterfeiting. The book also deals with problems with trade secret and its over-protection. It compares IP laws and four industries in India and China, and examines what role have IP laws played in the development in those industries and how India and China can learn from each other. Finally, it examines one medium and one small-sized Asian economy on its respective struggle (Taiwan's efforts to build a coherent IP exhaustion regime) and a success story (how Singapore has utilized IP to secure its position in global value chains).
